Your rights on a Wisconsin payday loan
Every licensed payday lender in Janesville works under Wis. Stat. s. 138.14 and hands you the state’s own borrower guide at signing. The protections below are quoted from that guide2, and you can read it in full on the DFI website before you sign anything.
- A borrowing ceiling. No more than $1,500 or 35% of your gross monthly income, whichever is lower.
- One day to change your mind. Return the money by the close of the next business day and the loan is cancelled at no charge.
- A repayment plan if you cannot pay. If you cannot repay in full at maturity, the lender must offer four equal installments timed to your pay dates, with interest after the maturity date cut to 2.75% per month. You are entitled to one such offer in any 12-month period.
- A limit on refinancing. You may pay off a payday loan with the proceeds of another payday loan only once.
- A refund for paying early. Clear the balance before the due date and part of the finance charge comes back to you.
- One presentation of your check or debit. The lender may present your check once, and may initiate one electronic transfer for each authorization you give.
- A capped bounced-payment fee. $15 if your check is dishonored or your transfer is denied.
- No wage garnishment. A lender may sue in small claims court but may not garnish your wages or threaten criminal charges.
- Notice to your spouse. If you are married and your spouse does not know about the loan, the lender must send them written notice.
