Limitation of Liability
EXCEPT WHERE PROHIBITED BY LAW, NEITHER CASH LOANS BEAR NOR ITS PARENT COMPANIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS ARE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES THAT RESULT FROM OR ARE RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY LINKED THIRD‑PARTY SERVICES.
CASH LOANS BEAR’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID DIRECTLY TO CASH LOANS BEAR TO ACCESS THE SITE DURING THE TWELVE (12) MONTHS PRECEDING THE DATE YOUR FIRST CLAIM AROSE.
CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
CASH LOANS BEAR IS NOT RESPONSIBLE FOR ANY ACTS, OMISSIONS, DELAYS, ERRORS, REPRESENTATIONS, WARRANTIES, BREACHES, OR NEGLIGENCE OF THIRD‑PARTY LENDERS OR SERVICE PROVIDERS, NOR FOR ANY PERSONAL INJURIES, PROPERTY DAMAGE, LOSSES, OR EXPENSES ARISING FROM THEM.
Dispute Resolution
By using the Site, you agree to be bound by the Agreement for Resolving Disputes (the “Disputes Agreement”).
Governing Law
These Terms of Use and any dispute, claim, or controversy arising out of or relating to your use of the Site shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.
Mandatory Arbitration
Except as otherwise provided below, any dispute, controversy, or claim arising out of or relating to these Terms, your use of the Site, or any services provided by Cash Loans Bear shall be resolved by binding arbitration. This means that you and Cash Loans Bear agree to waive the right to resolve any dispute through a court of law or by a judge or jury, except as expressly allowed in this section.
Arbitration Rules
The arbitration shall be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted by a single, neutral arbitrator, selected in accordance with those rules. The arbitrator shall have the authority to award all remedies available under applicable law, subject to the limitations set in these Terms.
Class Action Waiver
You and Cash Loans Bear agree that arbitration will be conducted only on an individual basis, and not in a class, collective, consolidated, or representative action. The arbitrator shall have no authority to join or consolidate claims of multiple individuals or preside over any form of class or representative proceeding. By agreeing to arbitration, you waive the right to participate in any class action or similar proceeding against Cash Loans Bear.
Jury Trial Waiver
To the fullest extent permitted by law, you and Cash Loans Bear each waive any right to a trial by jury in any action, proceeding, or counterclaim arising from or related to these Terms or your use of the Site.
Arbitration Location and Procedure
Unless otherwise required by applicable law or agreed upon by the parties, the arbitration shall take place in Baltimore, Maryland. You agree to submit to the personal jurisdiction of that location for the purpose of enforcing the arbitration award. Hearings may be conducted in person, by video conference, or by telephone, at the discretion of the arbitrator.
Opt‑Out of Arbitration
You may opt out of mandatory arbitration by providing written notice to Cash Loans Bear within 30 days of your first use of the Site or acceptance of these Terms. To opt out, you must send a signed letter stating your name, address, email address, and a clear request to opt out of the arbitration provisions of these Terms to main@loansbear.com.
If you opt out of arbitration, you retain the right to bring an individual claim in a small claims court within the State of Maryland, provided that the claim remains within that court’s jurisdictional limits.
Termination
Cash Loans Bear reserves the right, in its sole discretion and without prior notice, to suspend, restrict, or terminate your access to the Site or any related services at any time for any violation of these Terms of Use.
Upon termination, your right to access and use the Site will immediately cease, and any licenses granted to you under these Terms will be revoked. Cash Loans Bear will not be liable to you or any third party for any termination of access or removal of content.
Severability and Entire Agreement
If any provision of these Terms of Use is held to be invalid, unlawful, or unenforceable by a court or competent jurisdiction, the remaining provisions of these Terms of Use shall remain in full force and effect to the maximum extent permitted by law.
These Terms of Use, together with our Privacy Policy and any other policies or legal notices, constitute the entire agreement between you and Cash Loans Bear with respect to your use of the Site and supersede all prior or contemporaneous communications, understandings, and agreements, whether written or oral, relating to the subject matter hereof.
